INTRODUCTION

goodbuy, Inc. (“goodbuy”, “we”, “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect and processes your personal information (also known as ‘personal data’) through our websites, software applications, browser extension, other online services, and mobile applications that link to or reference this Privacy Policy (together "the Services"). Please read this Privacy Policy carefully.

If you do not agree with the terms of this Privacy Policy, please do not access the Services or download the browser extension. Your use of the Services, including any browser extension, is your acknowledgement and agreement to the terms of our Privacy Policy and any other applicable agreement that may be provided together with the Services. We reserve the right to make changes to this Privacy Policy at any time and for any reason.

We will alert you about any changes by updating the “Last Updated” date of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Services, and you waive the right to receive specific notice of each such change or modification. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Services after the date such revised Privacy Policy is posted.

What Personal Information Do We Collect?

We collect your personal information in order to provide and continually improve our products and services.

Here are the types of personal information we collect:

  1. Information You Give Us: We receive and store any information you provide in relation to the Services. See Section 1 below for examples of the information we collect. You can choose not to provide certain information, but then you might not be able to take advantage of the Services.
  2. Technical Information: We automatically collect and store certain types of information about your use of the Services, including information about your interaction with content and services available through the Services. Like many websites, we use "cookies" and other unique identifiers, and we obtain certain types of information when your web browser or device accesses the Services and other content served by or on behalf of us on other websites.   3. Information from Other Sources: We might receive information about you from other sources, such as from publicly available sources, public websites, social media, and suppliers and vendors. See Section 3 for additional examples of the information we receive.
For What Purposes Does We Use Your Personal Information?

We may use your personal information to create a profile of your preferences to personalize and tailor products and services content that may be of interest to you.  For example, we may use your personal information to operate, provide, develop, and improve the products and services that we offer our customers, to provide you marketing information, to protect you, other Services users and our business, and to comply with applicable laws. Use of Cookies and other Data Collection Tools

Cookies are small text files placed on a user’s computer or smartphone and are commonly used to collect personal information. Cookies are sent to your browser from a website and stored on your device. To enable our systems to recognize your browser or device and to provide and improve the Services, we use cookies and other data collection tools and similar technologies, such as pixels. These data collection tools measure and track customers' visits to and browsing activities as part of the Services and to compile sales and statistical data.

For example, beacons let us know when a purchase is made on one of our websites by a member of one of our third-party affinity or affiliate programs and when a purchase is initiated by an advertisement that we placed on a third party's website. Web Browser Settings

You can opt out of our use of cookies to recall information about you by setting your browser not to accept cookies or to disable cookies. Most browsers also offer additional built-in tools to help you manage, control, and delete cookies, including cookies used for advertising.

We support the development and implementation of a standard "do not track" browser feature that provides customers with control over the collection and use of information about their web-browsing activities. Once a standardized "do not track" feature is released, we intend to adhere to the browser settings accordingly.

Website Analytics

We use various service providers to collect and analyze certain information about our users’ and customers' browsing history, purchasing patterns (such as pages viewed, and links clicked) on various platforms and Services. We may also partner with selected third-party vendors to allow tracking technologies and remarketing services on the Services through the use of first party cookies and third-party cookies, to perform certain functions, among other things, analyzing and tracking users’ use of the Services, determining the popularity of certain content and gaining a better understanding of online activity. By accessing the Services, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policies and contact them directly for responses to your questions. If you do not want any information to be collected and used by tracking technologies, you can visit the third-party vendor or the Network Advertising Initiative Opt-Out Tool or Digital Advertising Alliance Opt-Out Tool.

Do We Share Your Personal Information?

Information about our website users and customers is an important part of our business, and we are not in the business of selling our customers' personal information to others for money. However, we share our users and customers' personal information as described below, and with affiliates as part of our Affiliate Program.

  1. Third-Party Service Providers: We may share various categories of your personal information with third-party service providers to perform business functions on our behalf, and under our contractual instructions.  Some examples include: fulfilling orders for products or services, delivering packages, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing payments, transmitting content, scoring, and providing customer service. These third-party service providers may have access to your personal information needed to perform their functions on our behalf, but they may not use it for other purposes.
  2. Business Transfers: As we continue to develop our business, we might sell or buy other businesses or services. In such transactions, user and customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing privacy policy (unless, of course, you consent otherwise). Also, in the unlikely event that goodbuy.com, Inc. or substantially all of its assets are acquired, your personal information may be one of the transferred assets.
  3. Transactions Involving Third Parties: We may make third party services, products, applications, or skills available for you to use on or through the Services. Where this is the case, note that such third parties may process your personal information collected through such sites or programs for their own purposes.  When you click on a link to a third-party site presented on our Services, you evidence your intent to interact with that business through our Services, and thereby are directing us to disclose certain personal information about you (including the link you clicked in our Services and a unique ID assigned to track that you originated from our Services) to an affiliate network to properly account for your interaction with a third-party service provider.  In such case, since you are being made aware of our practices under this Privacy Policy, should you decide to use a third-party product or service made available to you on our Services, our sharing of your personal information with these third-party service providers, is not considered a “sale” of your personal information as that term is defined in the California Consumer Privacy Act of 2018 (“CCPA”).  We do not accept any responsibility or liability for such third parties’ sites or programs. Please check such third parties’ terms of use and privacy policies before using and providing any information to such third parties’ sites and programs.  
  4. Protection of Us and Others: We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our other agreements; or protect the rights, property, or safety of us, our users, or others.
How Do We Keep Your Personal Information Secure?

The security of your personal information is important to us. We use appropriate technical and organizational safeguards to protect your personal information from unauthorized use, disclosure, and loss. Encryption technology, including current industry-standard encryption protocols, is used to protect personal information in certain areas of our Services during transmission across the internet.  As a matter of security, we do not disclose the specific details regarding our security posture as this information could be used by criminals and other bad actors.  For more information on our security practices, please contact us.

What About Marketing and Advertising?

We also collect and use the personal information of our clients and other companies with which we have an existing business relationship for marketing purposes and to carry out any contractual commitments we have with our clients. We may also obtain contact information from public sources, including content made public at social media websites, to make an initial contact with a relevant individual at a potential client or other company.

In accordance with applicable marketing laws, we send commercial emails to individuals at our clients or other companies with whom we want to develop or maintain a business relationship.  Our targeted e-mail messages typically include web beacons, cookies, and similar technologies that allow us to know whether you open, read, or delete the message, and links you may click.  When you click a link in a marketing e-mail you receive from us, we will also use a cookie to log what pages you view and what content you download from our websites, even if you are not registered at or signed into our Services.

Targeted e-mails from us may include additional data privacy information, as required by applicable laws.  Our Services may include third-party advertising and links to other websites and apps. Third-party advertising partners may collect information about you when you interact with their content, advertising, and services. We do not accept any responsibility or liability when you choose to interact with such third parties content or access their site.  Please check such third parties’ terms of use and privacy policies before using and providing any information to such third parties’ sites and programs.  You can exercise your right to prevent marketing communications to you by checking certain boxes on the forms we use to collect your personal data, or by utilizing opt-out mechanisms in e-mails we send to you. You can also exercise the right to discontinue marketing communications to you, or to have your personal data removed from our databases at any time by contacting us. In such cases, we will retain minimum personal data to note that you opted out in order to avoid contacting you again.

International Transfers of Personal Information

We do not engage or allow for the international transfer of your personal information.  If in the event of an international transfer of your personal information, we will transfer such personal information in accordance with the applicable data privacy laws.

Children’s Privacy

We offer our products and services for the exclusive use of adults (18 and older). We don't knowingly collect or solicit personal information from children. If you are a child under 18, please do not attempt to use or register for goodbuy’s products or services or send any personal information to us.

If we learn that we have collected personal information from anyone under 18, we will delete that information as quickly as possible. If you are a parent or guardian of a child who you think may have given us some personal information or posted information on any public portion of goodbuy’s products or services, please let us know at hello@trygoodbuy.com. We'll help you remove it.

Retention of your Personal Information

We retain your personal information as follows:

The period during which we store your personal information varies depending on the purpose for the processing:

  1. For the provision of our products and services, for so long as you are a customer;
  2. For marketing purposes, until you have opted out of receiving further direct marketing communications in accordance with applicable law.
  3. In all other cases, we store your personal information for as long as is needed to fulfill the purposes outlined in this privacy statement or such retention period as required by law, following which time it is either anonymized (where permitted by applicable law), deleted or destroyed.
  4. Protection of Us and Others: We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our other agreements; or protect the rights, property, or safety of us, our users, or others.
California

Below, you will find "Your Rights Under the California Consumer Privacy Act" section, which is referred to as the "CCPA Notice". The California Consumer Privacy Act ("CCPA") provides certain new rights to "consumers" who are residents of California, and this CCPA Notice explains how we enable those rights for California residents who are customers or prospective customers using our services and explains our California personal information practices as required by CCPA.

CCPA requires a summary of personal information practices for the prior twelve months, updated annually, and that summary for calendar year 2020 is reflected in this CCPA Notice. We may update our Privacy Policy more frequently than annually or provide additional notice such as at the point of collection, to reflect material changes in how we collect and use personal information.

This CCPA Notice supplements our other privacy notices and policies and shall govern in the event of a conflict between this CCPA Notice or other privacy notices and policies. However, if any other notice about CCPA is provided at the point of collection, then that other notice shall govern in the event of a conflict with this CCPA Notice as permitted by applicable law.

NOTE FOR NON-CUSTOMERS. Please note that this CCPA Notice does not apply to certain human resources data or business-to-business communications data, or those individuals.

Managing your Personal Information

You can always adjust your personal settings regarding what information you share and how goodbuy communicates with you by going to your account page and clicking on the “personalize” or “emails” headings. Please note that limiting the information you offer to provide may impact goodbuy's ability to provide suggestions or offers to you.

If you want to stop using goodbuy, we have instructions on how to uninstall the browser extension on our website.  You can also uninstall the goodbuy mobile app in the same way you would uninstall other mobile apps from your mobile device.

Deletion of User Data

To request a deletion of all user data, please email hello@trygoodbuy.com with the subject "Delete User Data" from the same email address where you would like your data deletion. The deletion will be processed and completed within 10 business days.

Name, pronoun, all types of identifiers and contact details (such as e-mail, phone numbers, physical address (including country)) and occasionally, when necessary for specific purposes, gender, date of birth, and age.

Commercial information (payment information)

History and records of the products and services you have obtained from us.  Any payment information will be handled directly by our payment processor, and we will not have access to any credit card information.

Marketing and research information

•Identifiers – the IP address, social media handle or other online identifiers of a person, e-mail address/mobile number if used for direct marketing, and name and address.

•Demographic data - (e.g. income, family status, age bracket, gender, interests, pets, home ownership, health, current service providers).

•Event information – when you sign up for our events.

•Browser/web history data and preferences expressed through selection, viewing, purchase of goods, services and content.

•Social media content – blogs, posts and anything posted by an individual online or which mentioned, references an individual.

•Analytics and profiles of the individuals based on the data collected on them.

Derivative Data.

Operating system, browser type, access times, pages viewed before and after accessing the Services, likes and replies to a post, and other interactions with the Services.

Social Media Sites.

Data collected from social media sites includes blogs, posts and anything posted by an individual online or which mentions or references an individual, and other publicly available information.

System and application access data and internet and electronic network activity information.

Where you are provided with access to our systems, we may collect information required to access such our systems and applications such as email account, and system passwords, including any accounts that might be linked to your access such as those from Facebook or Google.  We will not access any information about your third party accounts used to access our website.

Cookies and geolocation data.

As described above, we may also collect geolocation data in some circumstances.  Please see our Cookie Policy for more details regarding our cookie use.

  3. The location of your device or computer;
  4. Content interaction information, such as content downloads, streams, and playback details, including duration and number of simultaneous streams and downloads, and network details for streaming and download quality, including information about your internet service provider;
  5. Device metrics such as when a device is in use, application usage, connectivity data, and any errors or event failures;
  6. Services metrics (e.g., the occurrences of technical errors, your interactions with service features and content, your settings preferences and backup information, location of your device running an application, information about uploaded images and files such as the file name, dates, times and location of your images);
  7. Version and time zone settings;
  8. Purchase and content use history, which we sometimes aggregate with similar information from other customers;
  9. The full Uniform Resource Locator (URL) clickstream to, through, and from our websites, including date and time; products and content you viewed or searched for; page response times, download errors, length of visits to certain pages, and page interaction information (such as scrolling, clicks, and mouse-overs);
  10. Phone numbers used to call our customer service number; and
  11. Mobile device data ID model.

We may also use device identifiers, cookies, and other technologies on devices, applications, and our web pages to collect browsing, usage, or other technical information.

Purpose:

  1. Purchase and delivery of products and services. We use your personal information to take and handle orders, deliver products and services, process payments, and communicate with you about orders, products and services, and promotional offers, including those companies belonging to our affiliate program, with whom you may choose to purchase products and services.
